Privacy Policy
1.1 Data Controller. modernwebcanvas, located at Passeig de Gracia 43, 08007 Barcelona, Spain, is the data controller responsible for the processing of personal data collected through this website and associated services.
1.2 Data Collection. We collect personal data including, but not limited to: full name, email address, phone number, company name, project specifications, and billing information. This data is collected exclusively for the purpose of executing requested services, communicating project updates, and processing payments.
1.3 Legal Basis. Processing is conducted under Article 6(1)(b) of the GDPR — performance of a contract — and Article 6(1)(a) — consent provided via explicit form submission. You may withdraw consent at any time by contacting [email protected].
1.4 Data Retention. Personal data is retained for the duration of the contractual relationship plus 24 months for warranty and support obligations. Financial records are retained for 6 years in compliance with Spanish tax legislation (Ley General Tributaria).
1.5 Third-Party Sharing. Data may be shared with: payment processors (Stripe, Inc.) for transaction processing; hosting providers for website deployment; and analytics services (Google Analytics) for performance monitoring. All third-party processors operate under signed Data Processing Agreements (DPAs).
1.6 Your Rights. Under GDPR Articles 15–22, you have the right to: access your personal data (Art. 15), rectification (Art. 16), erasure (Art. 17), restrict processing (Art. 18), data portability (Art. 20), and object to processing (Art. 21). Requests should be directed to [email protected] and will be addressed within 30 days.
Terms of Service
2.1 Scope of Services. modernwebcanvas provides web design, development, and digital strategy services as outlined in individual project proposals. All services are delivered in accordance with the specifications defined in the signed project agreement between modernwebcanvas and the client.
2.2 Payment Terms. Invoices are issued per the milestone schedule defined in the project agreement. Payment is due within 14 calendar days of invoice date. Late payments incur a 1.5% monthly interest charge. All prices are quoted in EUR and are exclusive of applicable VAT (IVA) at the prevailing Spanish rate.
2.3 Intellectual Property. Upon full payment, all deliverables including source code, design files, and content become the exclusive property of the client. modernwebcanvas retains the right to display work in portfolio and case studies unless explicitly restricted in the project agreement.
2.4 Project Timeline. Estimated timelines are provided in good faith based on current workload and project complexity. Delays caused by client-side factors (late feedback, delayed asset provision) may extend timelines proportionally. modernwebcanvas will communicate any anticipated delays within 48 hours of identification.
2.5 Limitation of Liability. modernwebcanvas's total liability under any project agreement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.
2.6 Termination. Either party may terminate with 14 days' written notice. Upon termination, the client is invoiced for all work completed to date. Work product delivered up to the termination date remains the client's property upon payment.
Refund & Reimbursement Policy
4.1 Pre-Project Cancellation. If a project is cancelled before any work has commenced, a full refund of any advance payment will be issued within 14 business days. "Commencement" is defined as the first billable hour logged against the project.
4.2 Mid-Project Cancellation. For projects cancelled after work has commenced, the client is invoiced for all hours worked to date at the agreed hourly or milestone rate. Any advance payment exceeding the invoiced amount will be refunded within 14 business days.
4.3 Deliverable Disputes. If a delivered milestone does not materially conform to the specifications defined in the project agreement, the client may request revision at no additional cost within 14 days of delivery. If revision cannot resolve the discrepancy, a proportional refund for the non-conforming deliverable will be assessed.
4.4 Non-Refundable Items. Domain registration fees, third-party license costs, stock asset purchases, and hosting setup fees are non-refundable once procured on behalf of the client. These costs are itemized separately in project proposals.
4.5 Refund Process. Refund requests must be submitted in writing to [email protected]. Refunds are processed to the original payment method within 14 business days of approval. Spanish IVA (VAT) refunds are subject to applicable tax regulations.
